Terms and conditions

1. General information

Point4pets is a registered trademarks and fall under Dutch jurisdiction. Point4pets sees itself as seller and sees every customer that makes use of the services provided as a buyer. These terms and conditions apply to relations that form between buyers and us as a seller. Point4pets assumes that every buyer has taken into account these following terms and conditions.


2. Agreements

Agreements with Point4pets are seen as binding. Cancellation of orders is only possible when Point4pets has stated this in correspondence. The consumer will be charged, when legally permitted, fees for this.


3. Making the agreement

Agreements will be made when a buyer has made an order and Point4pets has ruled it to be attainable. Point4pets has the right to cancel orders or to make extra conditions under which the sell will be made. Point4pets will in this case inform the buyer before action will be taken.


4. Pictograms

Pictures, drawings and information concerning seizes, weights, colours and other features or only an indication for the real product. Only large discrepancies will be reason for damage repayments.


5. Prices

The product that Point4pets sells will be sold against prices that were displayed to the buyer when the sell was made. Point4pets maintains the right to not process the order when mistakes are made. In these case the buyer will be contacted and there will possibly be made a new agreement, in such case, no extra fees will be charged.


6. Sending and shipping

The delivery time for order is normally no more than 2 weeks unless stated differently. This delivery time is an indication and no fatal term. When the agreed delivery time for whatever reason is not being met, Point4pets will contact the customer by writing or by telephone. In that case the customer is allowed to end the agreement with Point4pets, by explicitly stating this by writing (fax, letter, e-mail) to Point4pets. Payments being made in such an agreement will normally be made to the customer within 7 working days, with a fatal term of 14 working days. The as an indication given delivery times can never be interpreted as a fatal term, unless stated in such a way with the buyer. Delivery is being made on the place and time when goods are ready for delivery. Point4pets maintains the right to send only parts of the products being ordered and to bill it as such. Point4pets transfers the risk of the goods when the delivery as being made to the address given by the buyer. When on request of the buyer delivery will be postponed or forwarded the costs attached to this will be transferred to the buyer.Point4pets maintains the right the transfer extra expenses being made Point4pets when circumstances beyond our control will take place. Point4pets does not have to deliver products that are being supplied any more or for other reasons that they are not longer part of the selling inventory. The buyer is obliged to accept delivered goods. When this is not being met, expenses for storage will be transferred. When these products are not taken by the buyer within 3 weeks from a by Point4pets determined storage place, we maintain the right to take these back in inventory and sell them. All costs being made will be for the buyer of the product. Damage repayments by not meeting the indication of the delivery time will never be given. As stated before the buyer maintains the right to end the agreement.

7. Cooling down period
After the customer has received the product he maintains the right to end the agreement and send the product back within 7 working days. The customer does not have to indicate any reason for this. In such a case the risk for sending the product is on the customer. The products must be send to Point4pets determined place.  Point4pets may assume the products to be returned in the original state. When this is not the case costs will be transferred to the buyer. Payment being made previously of ending the contract will be transferred back. Fatal term being applied in this case is 14 days. Point4pets maintains to right no not take back returned used or damaged products or to credit only a limited amount of the total amount that has been paid if this is not due to 4youroutdoor or one of his suppliers. When a product is being returned that in the opinion of Point4pets is due to neglectance is being damaged and can be contributed to the buyer, Point4pets will contact the buyer by writing (fax, letter, e-mail). Point4pets maintains the right to not give back the full amount of money concerning the returned goods due to such damage.

8. Payments
Payments to Point4pets are being made by bank wire transfers on a Point4pets determined bank account or by making a cash payments after the services are being made. After delivery of the goods payments have to be made within 14 days on a by Point4pets determined bank account. Point4pets maintains the right to demand products back or the raise the payable amount be 2% when a credit facility will be made. Discounts can be deducted from the price unless terms of payments are not being met or/and payments in the past have not been made. When the buyer does not meet the fatal payment term the payable amount will be increased by 2% a month, in which parts of months count as whole months. When the buyer does not pay within the fatal term and cash collection has been taken place by a legal collection, legal tariffs will apply with a minimum of 100 euro’s. When payments are not being made on time Point4pets is not obliged to meet the agreements terms as well. Damage repayments have to made to Point4pets.Point4pets has the right the demand the buyer to secure payments being made by a Point4pets predetermined way. Payments will be made in euro’s unless agreed otherwise with the buyer.

9. Property of the goods
Property of the goods lies with Point4pets till the moment payments are being made, including damage repayments, extra expenses and interest. It is not permitted to transfer goods within have a written permission by Point4pets, this included renting, selling and placing goods outside their company. The buyer will give Point4pets the right to access the place goods when terms are not being met. When in correspondence with the terms the agreement is being met the property will transfer to the buyer. The buyer will on first request of Point4pets cooperate with actions that have to take place in the process of taking back goods. A non-compliance penalty of 10,00 euro’s a day will take place if the buyer is being neglectant. Goods that are being replaced due to warranty agreements or damage repairments will maintain Point4pets’s property until agreements are being met.

10. Complaints
All complaints concerning payments and goods should be made within 7 working days by writing and must contain a clear description of the complaint to Point4pets. Small differences or in business normal or unavoidable defects and differences in quality, color, measure or refinements, cannot make any basis for complaints. The buyer should always give Point4pets time to repair damaged goods. When goods are being send back this is on the risk of the buyer. Point4pets will only accept these goods if agreed by writing and if they are being delivered to a by Point4pets given address in the original package and in the state Point4pets supplied the goods to the buyer.

11. Warranty agreements
Point4pets stand in for the quality of the delivered goods and services and will provide a warranty in how far this is agreed with the customer. On goods with a value above 200 euro’s a warranty for 1 year is usually provided. On other goods no warranty will be given unless a legal one. When the buyer will give their goods for repairment to Point4pets and won’t have collected them including a payment being made for the payable amount after 3 months Point4pets will consider them is their property. There won’t be any legal obligation between agreements made with third parties by the buyer and Point4pets. Goods that have disorders falling within this warranty will be repaired or replaced as soon as possible or the amount being paid will be credited to the buyer. Goods that apply for replacement or repairmen must first be indicated to Point4pets by the buyer by writing. Point4pets will get these goods on a with the buyer agreed place or to a Point4pets indicated place they have to be send with a specific complaint description. For goods that don’t feel under a supplier determined warranty the following applies. The buyer cannot make use of the warranty if:
The goods are being neglected
The buyer has made alterations or has let repairments made by third parties
By not using goods carefully or by a nature caused problem
The goods have not been used as prescribed
The goods are being used with wrong accessories
When the buyer has used the goods inproperly in any other way
Whey the buyer does not meet 4youroutdoor agreements warranty agreements don’t apply.

12. Trademark
Trademarks and identification numbers may not be removed by the customer and or not allowed to be changed.

13. Liability claims
Point4pets limits his responsibily as far as services of third are being used and cannot be hold accountable in the following cases:
Not making a delivery or not making it on time
For incorrect data in brochures, catalogues, commercial material, mails, internet-advertising, price indications and so on
In cases of events that could not be foreseen
If a buyer makes alterations to the product or does repair it with the use of third parties or uses it for inproperly
Damage that has been made intentionally or assisting people can be blamed for shortcomings


14. Shortcomings outside the warranty
Point4pets can never be hold accountable if they cannot meet agreement due the circumstances beyond their control. These consist of circumstances in which every strange cause or circumstance takes place that cannot be traced back to Point4pets. Delays or bad performance by suppliers, transport possibilities, strikes, government measurements, delays in supply, sickness by staff will count as circumstances beyond our control. Point4pets maintains the right in such case to postpone the agreement being made, or make alterations to the agreement. Point4pets is in no circumstance due to make any payments to the buyer if these circumstances take place. Point4pets maintains the right to payments of made expenses and delivered work. If the agreement cannot be made there is no right to further postpone the agreement by  Point4pets.

15. Ending the agreement
When a buyer does not meet the obligations that go with the agreement being made towards Point4pets on time or does not meet them as intented, or the buyer goes in bankruptcy or makes an agreement that concerns creditors or the assets or the company are being impounded or the company is being sold, the agreement can be ended by Point4pets and the payable amount as defined is due from that point on. Point4pets is in such case entitled to ask for damage repayments and/or taking the goods back. When the buyer wishes to end the agreement, he must first signal this to Point4pets by writing and add specifically what shortcomings apply. This right ends if the buyer makes any shortcomings towards the agreements made with Point4pets. The buyer is obliged to meet the agreement of already delivered services.

16. Use of law
On all agreements Dutch law applies. Differences that come from an agreement between Point4pets and a buyer and follow from a premade agreement will be solved in front of a district court house. Unless other court houses applies or Point4pets wishes to solve this in the city of residence of the buyer.

17. Partially illegal conditions
If one or more conditions do not bind the buyer to follow with respect to Point4pets, other conditions still apply in the agreement being made. The buyer and Point4pets will then have to follow conditions that lie close to the original conditions being made, these conditions will then be part of the agreement.
